1. Services Provided

NightTechMoon LLC specializes in:

  • Accessibility Consulting: Audits, remediation plans, and compliance reports for WCAG 2.1 and ADA standards.
  • Assistive Technology Training: Training on tools such as JAWS, NVDA, ZoomText, and VoiceOver.
  • Inclusive Design & Development: Creating websites and applications that are accessible by default.

We reserve the right to modify or discontinue any service without prior notice.

2. User Obligations

When using our services, you agree to:

  • Provide accurate and complete information required to deliver services.
  • Use our services in compliance with applicable laws and regulations.
  • Avoid engaging in any activity that disrupts or interferes with our systems or services.

Failure to comply may result in termination or suspension of services without refund.

3. Payments & Billing

  • All payments are due according to the terms specified in the invoice or service agreement.
  • Late payments may result in service suspension or additional fees.
  • Pricing for custom projects will be provided in a written estimate prior to engagement.

4. Refund Policy

  • Before Project Initiation: Refunds are available, minus any administrative or processing fees.
  • After Project Initiation: Refunds are handled on a case-by-case basis, depending on project progress and costs incurred.
  • Completed Services: No refunds will be issued for services that have been fully delivered.

5. Intellectual Property Rights

All materials, designs, reports, and deliverables created by NightTechMoon remain our property until full payment is received. Upon payment, you receive a non-exclusive, non-transferable license to use the deliverables for your business.

6. Indemnification

You agree to indemnify and hold harmless NightTechMoon LLC, its affiliates, and employees from any claims, damages, or liabilities arising from:

  • Your misuse of our services
  • Violation of these Terms
  • Infringement of third-party rights due to your actions

7. Limitation of Liability

NightTechMoon LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities. Our total liability is limited to the amount you paid for the service in question.

8. Governing Law

These Terms are governed by and construed under the laws of the State of Michigan, USA, without regard to conflict of law principles.

9. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through informal negotiations. If unresolved, disputes will be settled by binding arbitration in Michigan, under the rules of the American Arbitration Association. You waive the right to participate in class actions.

10. Termination

NightTechMoon reserves the right to suspend or terminate services if you violate these Terms or engage in unlawful activities.

11. Changes to Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes your acceptance of the revised Terms.
